UPDATE from Cubanos en UK:

JustGiving has blocked the Cubanos en UK campaign to raise money to buy syringes, to help Cuba’s vaccination campaign against COVID-19. JustGiving has confirmed that its action is due to Cuba being 'one of the countries under sanctions [ from the United States ]'.

Those who donated to the JustGiving campaign will have their donations reimbursed.

Cubanos en UK has set up:

1) an online petition to complain against JustGiving and Crowdfunder UK for participating in the illegal blockade of Cuba. https://www.change.org/cubanosenuk

2) an alternative website for raising this money. https://www.support-vaccination.org/ Payment goes through GoCardless' payment account direct to Cubanos en UK.


Cuban medical and scientific institutions have announced that they will carry out this year a mass vaccination campaign for the entire population against COVID-19. The goal of Cubanos En UK (Cubans in the UK) is to make a modest contribution to this process by raising as much money as possible to buy medical supplies and send them to Cuba.

We are appealing to the generosity and solidarity of citizens in Britain and any other country in the world; the goal we have set ourselves is £25,000. Donations can be made online through the JustGiving collection platform.

When we started the project we did it using the British platform, 'Crowdfunder UK' but unfortunately we had to abandon it because it stopped accepting donations destined for our project. Despite the efforts made by the 'Crowdfunder UK' directive to solve the problem, we suspect that the main obstacle is the financial and economic sanctions imposed by the United States on Cuba; since the handling of payments on the 'Crowdfunder UK' platform are made by the US company 'Stripe', subject to OFAC regulations.

Although the extraterritorial application of sanctions against Cuba in the UK is illegal, this is not the first time that our association has been affected by such measures. We have also struggled using the services of other platforms including Eventbrite, PayPal and GoFundMe, in previous initiatives.

It is cruel to hamper humanitarian aid aimed at saving lives in Cuba or any other country. The application of collective sanctions violates international humanitarian law.

Several United Nations experts have recently urged sanctioning countries to "urgently lift, suspend or minimize" such coercive measures to reach affected nations medicines and medical equipment, food and fuel.

On 10 December 2020, Alena Douhan, UN Special Rapporteur on the negative impact of unilateral coercive measures on the enjoyment of human rights, called on national states to take 16 urgent measures "to prioritize saving lives in the course of COVID-19 over political and other interests." Among these measures were the following:

Humanitarian aid – human resources, materials, equipment, cash and/or otherwise – to combat the pandemic shall not be subject to any direct or indirect restrictions.

- No national law or regulation of regional international organizations shall have extraterritorial application. Therefore, any sanction, including administrative and criminal charges against individuals and companies involved in the delivery of medical products and food to sanctioned states in accordance with international humanitarian and human rights standards, must be lifted or at least suspended...

Despite the difficulties we face, we will continue with this fundraising campaign and denounce any attempt to hinder this project. No one will be able to block our willingness to help. Nor will they be able to block our values of humanism and brotherhood.

Las instituciones médicas y científicas cubanas han anunciado que llevarán a cabo este año una campaña de vacunación masiva a toda la población contra el  COVID-19. El objetivo de Cubanos en UK es hacer una modesta contribución a este proceso recaudando la mayor cantidad de dinero posible para comprar insumos médicos y enviarlos a Cuba.


Estamos apelando a la generosidad y solidaridad de los ciudadanos en Gran Bretaña y de cualquier otro país del mundo; la meta que nos hemos propuesto es de £25 000. Las donaciones se pueden hacer online a través de la plataforma de recaudación JustGiving.

Cuando comenzamos el proyecto lo hicimos usando la plataforma británica, ‘Crowdfunder UK’ pero desafortunadamente tuvimos que abandonarla porque paró de aceptar donaciones destinadas a nuestro proyecto. A pesar del esfuerzo hecho por la directiva de ‘Crowdfunder UK’ para solucionar el problema, sospechamos que el obstáculo principal son las sanciones financieras y económicas impuesta por los Estados Unidos hacia Cuba; dado que el manejo de los  pagos en la plataforma de ‘Crowdfunder UK’ son realizados por la compañía estadounidense ‘Stripe’, sujeta a las regulaciones de la OFAC. 

Aunque es ilegal la aplicación extraterritorial de las sanciones en contra de Cuba en el Reino Unido, no es la primera vez que nuestra asociación se ve afectada por este tipo de medidas. También hemos tenido dificultades usando los servicios de otras plataformas incluidas, Eventbrite, PayPal y Gofundme, en iniciativas anteriores.

Es cruel obstaculizar una ayuda humanitaria destinada a salvar vidas en Cuba o en cualquier otro país. La aplicación de sanciones colectivas, violan el derecho internacional humanitario.

Recientemente varios expertos en Naciones Unidas han urguido a los países sancionadores a “levantar, suspender o minimizar urgentemente” este tipo de medidas coercitivas con el objetivo de que lleguen a las naciones afectadas medicamentos y material médico, alimentos y combustible.

El 10 de diciembre de 2020, Alena Douhan, Relatora Especial de las Naciones Unidas sobre el impacto negativo de las medidas coercitivas unilaterales sobre el disfrute de los derechos humanos, pidió a los estados nacionales que tomen 16 medidas urgentes 'para priorizar salvar vidas en el curso del COVID-19 sobre intereses políticos y de otro tipo. '' Entre esas medidas estaban las siguientes:

 

- La ayuda humanitaria –recursos humanos, materiales, equipos, dinero en efectivo y / o de cualquier otro tipo– para combatir la pandemia no estará sujeta a ninguna restricción directa o indirecta.

- Ninguna ley nacional o regulación de organizaciones internacionales regionales tendrá aplicación extraterritorial. Por lo tanto, cualquier sanción, incluidos los cargos administrativos y penales contra personas y empresas involucradas en la entrega de productos médicos y alimentos a los estados sancionados de conformidad con las normas internacionales humanitarias y de derechos humanos, debe levantarse o al menos suspenderse…

Pese a las dificultades que enfrentamos seguiremos adelante con esta campaña de recaudación y denunciaremos cualquier intento de obstaculizar este proyecto. Nadie podrá bloquear nuestra voluntad de ayudar. Tampoco podrán bloquear a nuestros valores de humanismo y hermandad.
